What do I need to be legally married in Australia?

Alright, so you’re all set to tie the knot! Here’s the lowdown on making it official:

 

First up, you need a marriage celebrant – they’re the folks authorised to make your union official.

According to the Marriage Act of 1961, on your big day, your celebrant needs to be front and center to lead the ceremony where you and your partner exchange your sweet vows. Don’t forget to invite two friends who are over 18 to witness the magic or we can supply witnesses!

 

Once you’ve said “I do” and sealed it with a kiss, it’s time to sign the dotted line on your Certificate of Marriage. Your celebrant, you two lovebirds, and your witnesses all need to sign to make it official.

Unfortunately, you can’t livestream your wedding or send in a stand-in – you’ve got to be there in the flesh to make it legit.

Can we be married in Australia?

To be married in Australia couples must:

  • not be married to someone else
  • not be marrying a parent, grandparent, child, grandchild or sibling
  • be at least eighteen years old, unless a court has approved a marriage where one party is aged between sixteen and eighteen years old
  • understand what marriage means and freely consent to marrying
  • lodge a Notice of Intended Marriage form with an authorised marriage celebrant or minister of religion at least one month prior to the intended date of marriage
  • provide their original birth certificate or passport
  • provide two witnesses over the age of 18 years to witness their marriage ceremony.

If either party has been previously married, a divorce certificate or death certificate of the previous spouse is required. All foreign language documents must be officially translated to English.

What is the first step?

To get married in Australia, the first thing you need to do is lodge the Notice of Intended Marriage.

Once we receive your notice, we can order your official Commonwealth Marriage Certificate from Canberra and prepare all the legal paperwork you need for your wedding day. By lodging the Notice of Intended Marriage, you’ll have done the first step to getting hitched, now the fun part… selecting a date for your marriage.

Do you offer post ceremony celebrations?

Yes, we do! We are fully licensed and have various catering options. 

From canapes, mixed platters all the way to a set seated menu, you tailor your post wedding celebration however you would like!
